As a user of NomiDesk, you agree to:

• Provide accurate and complete information when using our Service
• Use the Service only for lawful purposes and in accordance with these Terms
• Respect the privacy and rights of other users
• Not attempt to interfere with or disrupt the Service
• Comply with all applicable laws and regulations

You may not use our Service:

• For any unlawful purpose or to solicit unlawful activity
• To violate any international, federal, provincial, or state regulations or laws
• To transmit or procure harmful, threatening, abusive, or defamatory material
• To violate any third-party rights, including privacy, publicity, intellectual property, or other proprietary rights
• To attempt to reverse engineer, decompile, or hack the Service

The Service and its original content, features, and functionality are and will remain the exclusive property of NomiDesk and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

You retain all rights to any content you provide to customize your school's chatbot, including school policies, procedures, and information. By providing this content, you grant us a license to use it solely for the purpose of providing our Service to you.

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices regarding the collection and use of your information.

We are committed to FERPA compliance and maintain strict data security measures to protect student and family information. All data processing activities are conducted in accordance with applicable privacy laws and regulations.

We strive to maintain 99.9% uptime for our Service, but we do not guarantee that the Service will be available at all times. The Service may be subject to planned or unplanned downtime for maintenance, updates, or due to circumstances beyond our control.

We reserve the right to modify or discontinue the Service (or any part thereof) temporarily or permanently with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

To the maximum extent permitted by applicable law, in no event shall NomiDesk, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

In any case, NomiDesk's aggregate liability for all claims relating to the Service shall not exceed the amount you paid to NomiDesk for the Service in the twelve (12) months preceding the claim.

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may simply discontinue using the Service and contact us to request account deletion.
